CONFISCATION OF CRIMINAL ASSETS ACT 2003 - SECT 209

A person commits an offence if—

        (a)     the person purports to give a form of search warrant to an issuing officer under section 204 (4) (b) (Issuing search warrants by telephone or other electronic means); and

        (b)     the document is not the form of search warrant that the person executed.

Maximum penalty: 200 penalty units, imprisonment for 2 years or both.

Note     A court has a discretion to admit improperly obtained evidence (see Evidence Act 2011

, s 138).
