CONFISCATION OF CRIMINAL ASSETS ACT 2003 - SECT 97

If the amounts paid into the trust fund to satisfy a penalty order are more than is required to fully satisfy the order, the public trustee and guardian must pay the surplus amount to the person against whom the order was made.
