Australian Capital Territory Current Acts Australian Capital Territory Current Acts(1) If an occupier of premises is present at the premises while an entry and search warrant is being executed, the occupier is entitled to observe the search being conducted.

(Cwlth), pt 1C applies in relation to the investigation of certain ACT offences.
(2) However, the occupier is not entitled to observe the search if to do so would impede the search.
(3) This section does not prevent 2 or more areas of the premises being searched at the same time.
