CRIMES (CHILD SEX OFFENDERS) ACT 2005 - SECT 132ZI

Offence—contravention of prohibition order etc

    (1)     A person commits an offence if––

        (a)     a prohibition order or interim prohibition order is in force for a person; and

        (b)     the person contravenes the order; and

        (c)     the person is reckless about whether the person is contravening the order.

Maximum penalty: 500 penalty units, imprisonment for 5 years or both.

    (2)     Subsection (1) does not apply to a person if the person has a reasonable excuse for contravening the order.

Note 1     The defendant has an evidential burden in relation to the matters mentioned in s (2) (see Criminal Code

, s 58).
