DANGEROUS GOODS (ROAD TRANSPORT) REGULATION 2010 (NO 12 OF 2010) - REG 246

Continuing effect of corresponding exemptions

    (1)     This section applies to an exemption (however described) that—

        (a)     was granted under a law regulating the transport of dangerous goods made by a State that has passed or has indicated that it intends to pass a corresponding law; and

        (b)     was in force in the other State immediately before the commencement of the Act; and

        (c)     is an exemption from compliance with a provision of the law of the other State (the corresponding provision ) corresponding to a provision of the Act.

    (2)     Except for circumstances that do not exist in the ACT, the exemption has effect for the Act as if it were an exemption granted by a corresponding authority from compliance with the corresponding provision.

Note     A reference to an Act includes a reference to the statutory instruments made or in force under the Act, including this regulation (see Legislation Act, s 104).
