(1) If an explosive is disposed of, the person who holds the licence under which the explosive is disposed must make a record of the disposal that complies with subregulation (2).
(2) The record must include the following information:
(a) the name and licence number;
(b) the owner of the explosive;
(c) the type and quantity of explosive;
(d) the date of disposal;
(e) the reason for disposal.
(3) The licensee must keep the record for at least 3 years after the date of disposal, whether or not the licence continues in force.
Maximum penalty: 20 penalty units.
(4) An offence against
this regulation is a strict liability offence.
Part 3.1 Kinds of fireworks
Note These regulations categorise fireworks as follows:
• general use fireworks (eg sparklers)—see reg 259 and pt 3.2
• consumer fireworks (eg ground spinners)—see reg 260 and pt 3.3.
• prohibited fireworks (eg large crackers or large aerial shells)—see reg 261.
