DANGEROUS SUBSTANCES (EXPLOSIVES) REGULATIONS 2004 (NO 10 OF 2004) - REG 291

Delivery records—consumer fireworks

    (1)     If the holder of a consumer fireworks licence takes delivery of a consignment of consumer fireworks, the licensee must, whether or not the licence continues in force, keep for at least 3 years—

        (a)     the delivery receipt given under regulation 290; or

        (b)     if the receipt is not kept—a record showing the following:

              (i)     the date of the delivery;

              (ii)     the kinds and quantities of fireworks delivered;

              (iii)     an explanation of why the receipt is not kept.

Maximum penalty: 20 penalty units.

    (2)     An offence against this regulation is a strict liability offence.
