DANGEROUS SUBSTANCES (EXPLOSIVES) REGULATIONS 2004 (NO 10 OF 2004) - REG 56

Manufacture records

    (1)     A person who holds a manufacturing licence must, for each explosive manufactured, make a record of the manufacture that complies with subregulation (2).

    (2)     The record must include the following information:

        (a)     the type and quantity of explosive;

        (b)     the date of manufacture;

        (c)     whether the explosive was manufactured for immediate use or supply, or, if it was stored, details of storage (including the details of any licence under the authority of which it was stored).

Note     If the explosive is disposed of, the licensee must make a record of the disposal under reg 258.

    (3)     The licensee must keep the record for at least 3 years after the date it is made, whether or not the licensee continues in force.

Maximum penalty: 20 penalty units.

    (4)     An offence against this regulation is a strict liability offence.
