Australian Capital Territory Numbered Regulations Australian Capital Territory Numbered Regulations(1) The Magistrates Court may order that discovery under regulation 74 by a party is not required or is limited to the documents, or to the matters in question in the proceeding, stated in the order.
Note The court may state in the order that discovery is limited to a class of documents, rather than individually named documents (see Legislation Act 2001 , s 48).
(2) The Magistrates Court may make the order before or after the party has been required under regulation 73 (Notice for discovery) to give discovery.
(3) The Magistrates Court must, on application by a party to the proceeding, make any order under subregulation (1) that is necessary to prevent unnecessary discovery.
