POISONS REGULATIONS (AMENDMENT) (NO. 13 OF 1988) - REG 3

Transitional

3. (1) In this regulation, “former Commissioner” means a Commissioner within the meaning of the repealed Health Commission Ordinance 1975.

(2) Where—

        (a)     at any time before 2 July 1988, an instrument was made, granted or issued, or an approval was given, by a former Commissioner under a provision of the Poisons Regulations amended by these Regulations; and

        (b)     the instrument or approval, as the case may be, had effect immediately before 2 July 1988;

then, on and after 2 July 1988—

        (c)     the instrument has effect as if it had been made, granted or issued by the Service; and

        (d)     the approval has effect as if it had been given by the Service;

under that provision as amended by these Regulations.

(3) A reference in an instrument referred to in subregulation (2) (other than Regulations) to a former Commissioner shall, in relation to any act or thing done or to be done on or after 2 July 1988, be read as a reference to the Service.
