ROAD TRANSPORT (SAFETY AND TRAFFIC MANAGEMENT) REGULATION 2017 (NO 45 OF 2017) - REG 6

It is a defence to an offence against this regulation if the defendant proves that the offence—

        (a)     was the result of an accident; or

        (b)     could not have been avoided by any reasonable efforts by the defendant.

Note     The defendant has a legal burden in relation to the matters mentioned in this section (see Criminal Code

, s 59).
