(1) A licensed second-hand dealer must keep records mentioned in regulation 8, 9 or 10 in such a way that transactions may be identified on both the basis of the date of the transaction and the kind of goods.
(2) The chief police officer may, in writing, issue directions to licensed second-hand dealers about the keeping of records.
(3) A direction is a notifiable instrument.
Note A notifiable instrument must be notified under the Legislation Act 2001 .
(4) If a direction is issued, the chief police officer must also publish a notice of the issuing of the direction in a daily newspaper published and circulating in the ACT.
(5) Subregulations (3) and (4) do not apply if the direction is addressed only to a licensed second-hand dealer named in the direction.
Note A direction addressed to a licensed second-hand dealer named in the direction must be given to the dealer in accordance with the Legislation Act 2001 , part 18.5 (Service of documents).
