WORK HEALTH AND SAFETY AMENDMENT REGULATION 2012 (NO 2) (NO 31 OF 2012) - REG 4

816A     Modification of Act, pt 20—Act, s 306

The Act, part 20 applies as if the following sections were inserted:

‘305A     Investigations under Work Safety Act 2008

    (1)     This section applies to an investigation under the Work Safety Act 2008 of an event, accident or other incident that happened before the commencement day.

    (2)     An inspector under this Act may exercise any function of an inspector under the Work Safety Act 2008 in relation to the investigation.

    (3)     This section expires on the day the Work Health and Safety Act 2011 , part 20 expires.

305B     Functions under director-general's delegations

    (1)     This section applies if—

        (a)     the director-general delegated a function of the director-general (the delegated function ) under the Work Safety Act 2008 to a person; and

        (b)     the delegation was in force immediately before the commencement day.

    (2)     The person may exercise the delegated function in relation to an investigation under the Work Safety Act 2008 of an event, accident or other incident that happened before the commencement day.

    (3)     This section expires on the day the Work Health and Safety Act 2011 , part 20 expires.

305C     Membership of Work Safety Council

    (1)     This section applies to a person who was a member of the Work Safety Council under the Work Safety Act 2008 immediately before the commencement day.

    (2)     The person is, on the commencement day, taken to be a member of the Work Safety Council appointed under this Act in the same capacity that the person was appointed under the Work Safety Act 2008 .

    (3)     The person's appointment ends at the end of the period stated in the appointment unless it is ended earlier.

    (4)     This section expires on the day the Work Health and Safety Act 2011 , part 20 expires.'
