EXPLANATORY STATEMENT
INTRODUCTION
This explanatory statement relates to the Animal Welfare Amendment Regulation 2014 (No 1) (Regulation). It has been prepared in order to assist the reader of the Regulation.
OVERVIEW
The Regulation makes minor amendments to the Animal Welfare Regulation 2001, replacing the definition of ‘code’ to mean the ‘Australian code of practice for the care and use of animals for scientific purposes, published by the National Health and Medical Research Council, as in force from time to time’.
The Regulation is made under the Animal Welfare Act 1992, which was
enacted to promote animal welfare and related purposes.
OUTLINE OF PROVISIONS
Clause 1 Name of regulation
This clause provides that the name of the regulation is the Animal Welfare Amendment Regulation 2014 (No 1).
Clause 2 Commencement
This clause provides for the commencement of the Regulation. The Regulation will commence on 1 July 2014.
Clause 3 Legislation amended
This clause provides that the Regulation amends the Animal Welfare Regulation 2001.
Clause 4 Legislation amended
Section 7 (1), note
This clause removes the note in section 7 (1) of the Animal Welfare Regulation 2001.
Clause 5 New section 7 (5) and (6)
New section 7 (5) specifies that section 47 (6) of the Legislation Act 2001
does not apply to the Australian Code of Practice. That section would require the text of the Australian Code of Practice to be remade as a new Disallowable Instrument every time the Australian Code of Practice is amended. The displacement of that section will ensure that the Australian Code of Practice can be applied automatically when it is amended by the National Health and Medical Research Council without the requirement to continually remake it as a Disallowable Instrument.
New section 7 (6) provides the definition of code. In this regulation Code means “the Australian code of practice for the care and use of animals for scientific purposes, published by the National Health and Medical Research Council, as in force from time to time to be adopted”.
Clause 6 Dictionary, definition of code
This clause removes the dictionary definition of ‘code’ from the Animal Welfare Regulation 2001. As explained above, a new definition of code has been inserted into new section 7 (6).
