STATEMENT

The intention of this amendment is to address a previous error in
drafting and insert ‘kg’ as the weight for Controlled Precursors
contained in columns 3 and 4 of Schedule 3.
This amendment clarifies the quantity for commercial and large commercial
quantities of controlled precursors under section 601 (1) of the
Criminal Code 2002, and ensures that Schedule 3 is free of
ambiguity.
Current drafting practice is to abbreviate terms of
measurement where ever possible, so that ‘kg’ is used instead
of ‘kilograms’ in full.
Regulation 1 – Name of regulation – provides
that the regulation is the Criminal Code Amendment Regulation
2008.
Regulation 2 – Commencement – provides
that the regulation commences on the day after its
notification.
Regulation 3 – Legislation
amended – provides that the regulation amends the Criminal Code
Regulation 2005.
Regulation 4 – Schedule 3, table, column headings – inserts ‘kg’ into column 3 (commercial quantity) and column 4 (large commercial quantity) of Schedule 3.
