Overview of the Amendment Regulation


The Civil Law (Wrongs) Amendment Regulation 2012 (No 1) (the amendment regulation) provides for the disclosure of confidential information under the Civil Law (Wrongs) Act 2002 (the Act) to public servants in prescribed circumstances.

Section 204(4)(f) of the Civil Law (Wrongs) Act 2002 provides that a person may disclose confidential information to a person, or for a purpose, prescribed by regulation.

The amendment regulation prescribes a process for the disclosure of confidential information in general reports requested by a public servant. The information may be disclosed if the public servant requesting the information certifies that he or she is responsible for administering a provision of the Workers Compensation Act 1951 on behalf of the Territory, and that the information will only be used for administering the provision.

1 Name of regulation

This clause states that this regulation is the Civil Law (Wrongs) Amendment Regulation 2012 (No 1).

2 Commencement

This clause states that this regulation commences on the day after its notification date.

3 Legislation amended

This clause states that this regulation amends the Civil Law (Wrongs) Regulation 2003.

4 New section 12A

This clause inserts a new section 12A in the Civil Law (Wrongs) Regulation 2003. New section 12A prescribes a process for the disclosure of confidential information in general reports requested by a public servant. The information may be disclosed if the public servant requesting the information certifies that he or she is responsible for administering a provision of the Workers Compensation Act 1951 on behalf of the Territory, and that the information will only be used for administering the provision.
