COURT PROCEDURES AMENDMENT RULES 2016 (NO 2) (NO 31 OF 2016)
The Rule-Making Committee (currently comprising the Chief Justice,
Justice Refshauge, Chief Magistrate Walker and Magistrate Campbell) may make
rules in relation to the practice and procedure of ACT courts and their
registries pursuant to section 7 of the Court Procedures Act 2004. The
Courts and the Joint Rules Advisory Committee have conducted a consultative
review of the rules which has resulted in the amendments contained in the
Court Procedures Amendment Rules 2015 (No 3).
Registrars’
powers
Rules 6250 and 6251 and Schedule 5 have been amended to allow the
registrar of the Supreme Court and the Registrar of the Magistrates Court to
make an order under rule 4050(1) (a) or (2), requiring the production of a
person in custody, either in person or via audiovisual link or audio
link.
These rules will commence on the day after their notification day.
