WATER SUPPLY REGULATIONS (AMENDMENT) 1988
EXPLANATORY
STATEMENT
No. 17 of 1988
Section 82 of the Electricity and Water Ordinance 1988
provides that the Minister may make regulations concerning the use and
management of the Canberra sewerage and water supply systems.
The
Canberra Sewerage and Water Supply Regulations (Amendment) provides an appeal to
the Administrative Appeals Tribunal from decisions made by the Engineer for the
Canberra Sewerage and Water Supply Regulations with respect to backflow
prevention devices.
The amendment gives effect to an undertaking to the
Senate Standing Committee on Regulations and Ordinances arising out of its
consideration of the Canberra Sewerage and Water Supply Regulations (Amendment)
(1987 No. 19).
Details of the Regulations are set out
below.
Regulation 117 is amended by inserting two new
paragraphs.
New paragraph 117 (da) provides an appeal from a refusal by
the Engineer under paragraph 100A (1) (a) to grant a work permit because the
Engineer is not satisfied that an appropriate backflow prevention device is to
be installed.
New paragraph 117 (db) provides an appeal from a refusal by
the Engineer under paragraph 100A (2) (b) to approve a device as a backflow
prevention device.
