EXPLANATORY
STATEMENT

OUTLINE
The purpose of this amendment of the Electoral Regulation 1993 is
to provide for the supply of confidential electoral roll data to the chief
executive of the Department of Treasury as a prescribed authority under section
65 of the Electoral Act 1992 for the purpose of assisting the chief
executive to contact former Totalcare employees about superannuation.
Electoral Roll information provided under this amendment will be used
for the purpose of contacting former employees of Totalcare Industries Limited
to seek details from them that would provide Totalcare with the relevant
decision mechanisms about their employment experience in order to facilitate
decisions about superannuation entitlements. Some of the former Totalcare
employees who live in Canberra are potential beneficiaries of Totalcare’s
outstanding superannuation liabilities.
This amendment allows the chief
executive to provide electoral roll data to another person or entity involved in
contacting former Totalcare employees about superannuation.
NOTES ON CLAUSES
Clause 1 Name of regulation
States that the name of the
regulation is the Electoral Amendment Regulation 2008 (No 1).
States that the regulation commences on the day after its notification
day.
States that the regulation amends the Electoral Regulation
1993.
New section 2 provides for a Dictionary at the end of the regulation.
The dictionary defines certain terms used in the regulation.
New section
3 provides for a Notes section that is explanatory, and not part of the
regulation.
These two sections are standard for a dictionary and
notes.
This clause omits the definition of “roll information”,
relocating it to the dictionary, because the definition is now used in two
sections.
This clause inserts new regulation 4A in the Electoral Regulations
to:
• make the chief executive of Treasury a prescribed authority to be
given confidential electoral roll information for the prescribed purpose of
assisting the chief executive of Treasury to contact a former Totalcare employee
about superannuation: and
• provide that the chief officer of
Treasury may give roll information to another person or entity only for the
purpose of contacting a former Totalcare employee.
The chief executive of
Treasury is defined as the chief executive of the Department of Treasury, and
superannuation is defined to include any superannuation matter associated with a
person’s former employment with Totalcare. Totalcare is defined as
Totalcare Industries Limited ABN 70 054 435 746.
This clause inserts a new dictionary of terms used in the regulations,
after regulation 5A. These are standard sections for a dictionary and notes.
