EXPLANATORY STATEMENT
Authority
This
Regulation is authorised by section 155 of the Education Act 2004 (the
Act).
Background
Section 38 of the Act provides that a
school board is established for each government school. Section 41 of the Act
prescribes the composition of a school board of a government
school.
Section 41(2)(f) of the Act provides that only those schools
prescribed in a regulation can have two student members elected by the students
at the school and appointed by the Chief Executive.
Schedule 1 of the
Education Regulation 2005 prescribes those schools whose school boards
include two student members elected by the students at the
school.
Purpose
This amendment regulation amends Schedule 1
of the Education Regulation 2005 to include the name of a school that
commenced operation in 2008 and included high school age students from
2011.
Details
An explanation of each clause of the
amendment regulation follows.
Clause 1 Name of regulation
The
first clause of the Regulation specifies that the name of the regulation is
the
Education Amendment Regulation 2012 (No 1). The Regulation amends
the
Education Regulation 2005, which is the subordinate law to the
Education Act 2004.
Clause 2 Commencement
Under this
clause, this Regulation will commence on 1 February 2013.
Clause
3 Legislation amended
This provision provides that this Regulation amends
the Education Regulation 2005.
Clause 4 Schedule 1, part
1.1
This provision substitutes a new table in Schedule 1, Part 1.1, of
the Education
Regulation 2005 that includes Harrison School
– the school opened at the
beginning of the 2008 school year and
included high school age students from 2011.
