STATEMENT

Environment Protection Amendment Regulation 2009 (No 3)
This regulation amends Schedule 1 of the Environment Protection Act
1997. Section 166(8) of the Environment Protection Act 1997 allows
Schedule 1 to be amended by regulation. The amendment inserts a threshold of
100m3 to the activity of the extraction of material (other than
water) from a waterway.
Clause 1 provides that the regulation is the Environment
Protection Amendment Regulation 2009 (No 3).
Under Clause 2 the regulation commences on the day after
notification.
The regulation amends the Environment Protection Act 1997 (See
Clause 3).
Clause 4 replaces Schedule 1, table 1.2, item 1 with ‘the
extraction of more than 100m3 of material (other than water) from a
waterway.’
