EXPLANATORY STATEMENT
SL2005-1

Aim and Purpose


This regulation aims to prescribe the position of the person holding the office of ‘director’ for the purpose of suspending, excluding or transferring a child within Catholic systemic schools, and prescribe the details of information to be held on the home education register.

Background
The Education Act 2004 was passed by the Legislative Assembly in March 2004. The Department of Education and Training is now implementing the Act.


Section 104 of the Act provides for the suspension, transfer or exclusion of a child from Catholic systemic schools by a person prescribed under regulation as the ‘director’. The regulations prescribe the position of Director, Catholic Education, Roman Catholic Church for the Archdiocese of Canberra and Goulburn for this purpose. This position is the most senior position within the Catholic systemic school system in the ACT and is equivalent to the chief executives’ position within the Department of Education and Training, who has similar powers within the government school system.

Section 133(1)(a) requires the chief executive to enter the particulars prescribed under regulation, of students approved for home education on the home education register. This regulation will require the following information to be kept on home educated students:
Child’s full name as shown on their birth certificate
Full name by which the child is known, if different from the birth certificate
The child’s sex
The child’s date of birth
A unique identifier number*
Full names of the child’s parents
The period for which the child is registered for home education
The address of the home base from which the home education will be carried out.

* The unique identifier number will be linked to the Student Transfer Register. This will enable tracking of students who move between school enrolment and home education.
