Overview
The Liquor Act 2010 replaced the Liquor Act 1975 and was
passed by the Legislative Assembly on 26 August 2010. The Liquor Act
2010 regulates the sale, supply, promotion and consumption of liquor in a
way that minimises harm associated with the consumption of liquor and takes into
account the safety of the community.
The Liquor Amendment Regulation
amends the Liquor Regulation 2010, which was made under the Liquor Act
2010 which commenced on 1 December 2010.
Under the Liquor
Act, it is mandatory for all people involved in the supply of liquor in
the ACT (including crowd controllers) who work at licensed premises to complete
an approved responsible service of alcohol (RSA) training course taught by an
ACT approved Registered Training Organisation. The commencement of the offences
of failing to hold an RSA certificate was delayed 12 months from commencement of
the Act on 1 December 2010.
The Liquor Amendment Regulation extends by
six months the stay of commencement of Division 8.1 (Responsible service of
alcohol) offences in the Liquor Act 2010, which will now commence on 1
June 2012, instead of 1 December 2011.
This Regulation is made under
sections 229 and 258 of the Liquor Act 2010.

Section 3 Legislation
amended
This section notes that this regulation amends the existing
Liquor Regulation 2010.
This section replaces section 250A(1) of Schedule 4 at section 4.1 of the
Liquor Regulation 2010 and delays commencement of the offences dealing
with the responsible service of alcohol (RSA) in Division 8.1 of the Liquor
Act 2010 until 1 June 2012. This will give the liquor industry additional
time to undertake RSA courses taught by an ACT approved Registered Training
Organisation.
