LITTER (SHOPPING TROLLEYS) AMENDMENT REGULATION 2012 (No 1)

Overview

Section 27 (1) of the Litter Act 2004 (the Act) permits the Executive to make regulations for the Act.

Section 24G (1) of the Act creates an offence for a retailer to fail to keep a shopping trolley identified as belonging to the retailer within the retailer’s shopping centre precinct. Section 24G (3) (c) of the Act exempts from this offence any retailer who provides a number of trolleys at their premises that is less than the number prescribed by regulation. Section 3 of the Litter (Shopping Trolleys) Regulation 2011 (the Regulation) prescribes this number as 40.

Section 4 of the Regulation provides it expires 1 year after the day it commences.

The Litter (Shopping Trolleys) Amendment Regulation 2012 (No 1) extends this sunset clause for another year.



Clause notes

Clause 1 Name of Regulation

This states that the name of the regulation is the Litter (Shopping Trolleys) Amendment Regulation 2012 (No 1).


Clause 2 Commencement

This clause states that the regulation commences on the day after its notification day.

Clause 3 Legislation amended
This clause states that the regulation amends the Litter (Shopping Trolleys) Regulation 2011.

Clause 4 Section 4
This clause amends section 4 of the Litter (Shopping Trolleys) Regulation 2011, to substitute its expiry from 1 year to 2 years after the day it commences.
