Overview


This regulation amends the Magistrates Court (Litter Infringement Notices) Regulation 2004 to expand the class of persons who may issue infringement notices for certain offences under the Litter Act 2004 to include police officers.

Background


The Magistrates Court (Litter Infringement Notices) Regulation enables infringement notices to be issued for certain offences against the Litter Act 2004.

Section Notes


Section 1 - Name of regulations - provides that the name of the regulation is the Magistrates Court (Litter Infringement Notices) Amendment Regulation 2005 No 1).

Section 2 - Commencement - provides that the regulation commences on the day after its notification day.

Section 3 – Legislation amended – provides that the regulation amends the Magistrates Court (Litter Infringement Notices) Regulation 2004.

Section 4 – Sections 10 and 11 – makes consequential amendments to sections 10 and 11 to provide that an infringement notice or reminder notice served by a police officer must identify the police officer by the service number for the police officer. This section also substitutes a new heading which reflects the changes made to the section.

Section 5 – Service of notices by authorised people – expands the class of persons who may issue infringement notices under the regulation to include police officers.
