MAGISTRATES COURT RULES (AMENDMENT)


EXPLANATORY STATEMENT


No. 15 of 1988

These Rules amend the Magistrates Court Rules to increase the charges payable upon provision by the Court of transcript of proceedings and copies of various other types of documents, and to remove certain exemptions from those fees.

Rule 1 provides that the proposed rules are to commence on the same day as the Magistrates Court (Amendment) Ordinance 1988. By virtue of subsection 12(2) of the Seat of Government (Administration) Act 1910, that Ordinance will commence upon Gazettal.

Rule 2 repeals subrules 68(2) – (5) inclusive of the Magistrates Court Rules and substitutes a new subrule (2). The changes effected by this amendment are:

• the charge for the provision of transcript or other documents is increased to $2.00 per page for the first transcript or copy of the document and 10¢ per page for each further transcript or copy provided to the same applicant; and

• exemptions from the former fees in favour of particular classes of persons are removed.
