AUSTRALIAN CAPITAL TERRITORY
POISONS
REGULATIONS (AMENDMENT)
EXPLANATORY
STATEMENT
No. 13 of 1988
The Poisons Regulations (Amendment) updates references in the Poisons
Regulations to “Commissioner” by substituting them with
“Service”. Service is defined in the Poisons and Dangerous Drugs
Ordinance 1933 as the Australian Capital Territory Community and Health
Service (the Service).
The Service is the new name of the A.C.T. Health
Authority which had its functions expanded and name changed following the
commencement of the Community and Health Service (Amendment) Ordinance 1988 on 2
July 1988.
The Poisons Regulations (Amendment) is part of a general
exercise to up-date legislation which previously referred to the Commissioner or
Capital Territory Health Commission. References at subregulation 4(1) and
paragraphs 16A(1)(a), 16A(2)(a), 16B(1)(c), 16B(2)(c) and 22(b) and (d) to
either those terms have been replaced with “Service” by regulations
1 and 2 of the Poisons Regulations (Amendment).
Regulation 3 of the
Poisons Regulations (Amendment) saves various instruments made, granted or
issued and approvals given by a former Commissioner (within the meaning of the
Health Commission Ordinance 1975) current when the amending Regulations
commenced.
