EXPLANATORY STATEMENT
Overview
The Road Transport (Offences) Amendment
Regulations 2002 amends the Road Transport (Offences) Regulations
2001. The new Regulations increase infringement notice penalties for some
traffic offences to maintain parity with NSW penalties for similar
offences.
1. The Road Transport (Offences) Amendment Regulations 2002 are to
commence on 1 July 2002.
2. Penalties for seat belt infringement notice
offences have been increased from $115 to $220 to increase the deterrent effect
and to remain consistent with NSW. All other infringement notice offences have
increased by around 2%.
3. Regulation 8 is amended to remove inaccuracies
in the list of offences relevant to each Administering Authority, specifically
the Road Transport Authority and the Chief Police Officer.
4. In the
table following, where an existing infringement penalty amount is listed in
Column 1, the new infringement penalty amount is listed in Column 2. In view of
the number of specific offences covered by the regulations, an example only of
an offence to which the penalty amount applies is provided in Column 3.
