EXPLANATORY STATEMENT
The Road Transport (Offences) Amendment Regulations 2004 (No 2) amend
the Road Transport (Offences) Regulations 2001.
Section 54(1)(c) of the Road Transport (General) Act 1999 provides
that the authority’s function may be delegated to an authorised person.
It is not necessary for a delegated person to also be an authorised person.
Section 54(1)(b) provides that the Administering Authority may delegate the
authority’s functions to a person prescribed under the regulations. New
regulation 14A provides that a public employee is a person to whom the
authority’s functions may be delegated.
