EXPLANATORY STATEMENT
The Road Transport (General) Act 1999, Section 25 (d) (iii)
establishes the contents of infringement notices to include the place where the
offence was committed.
Section 23 (2) (b) of the Road Transport (Safety & Traffic Management)
Act 1999 provides for a photographic or electronic image of a vehicle taken
by an approved camera detection device to be complying if the relevant
information for the image is indicated on the image. Section 22A defines
“relevant information” as (a) the date and time when, and place
where, the image was taken.
Section 24 (2) of the Road Transport
(Safety & Traffic Management) Act 1999 allows the regulations about
traffic offence detection devices to make provision about the meaning of codes
and other information indicated on images taken by approved camera detection
devices.
Schedule 1 of the Road Transport (Safety & Traffic
Management) Regulations 2000 sets out the location code and description of
each site at which certain traffic camera detection devices may be
operated.
This amending regulation amends Schedule 1 to insert references to an
additional ten declared sites, identified by the Camera Enforcement Safety
Management Committee, as crucial sections of road to be included for the
operation of mobile speed cameras.
These sites represent
“gaps” in the mobile speed camera network along existing major
routes. For example, Adelaide Avenue becomes Yarra Glen from the intersection
with Kent Street in Deakin. While Adelaide Avenue is a declared road Yarra Glen
is not.
This amendment will allow mobile speed cameras to operate along
the continuous section of road known as Adelaide Avenue and then Yarra Glen.
The amendment will similarly “fill in” gaps in the mobile speed
camera network on other major roads.

sites to be included on Schedule 1 of the Road Transport (Safety and Traffic
Management) Regulations are:
