EXPLANATORY STATEMENT
The Road Transport (General) Act 1999, Section 25 (d) (iii) specifies that infringement notices must include the place where the offence was committed.
Section 23 (2) (b) of the Road Transport (Safety & Traffic Management)
Act 1999 provides that a photographic or electronic image of a vehicle taken
by an approved camera detection device is complying if the relevant information
for the image is indicated on the image. Section 22A defines “relevant
information” to include the date and time when, and place where, the image
was taken.
Section 24 (2) of the Road Transport (Safety & Traffic
Management) Act 1999 allows the regulations about traffic offence detection
devices to make provision about the meaning of codes and other information
indicated on images taken by approved camera detection devices.
Section
108 of the Road Transport (Safety & Traffic Management) Regulation 2000
defines the meaning of codes and other information indicated on an image of a
vehicle taken by an approved camera detection device.
Schedule 1 of the
Road Transport (Safety & Traffic Management) Regulation 2000 sets out
the location code and description of each site at which certain traffic camera
detection devices may be operated.
In October 2005 the Government agreed to a policy change to enable all
remaining arterial, major collector and minor collector roads in the ACT to be
assessed for possible mobile speed camera use.
This amending regulation
amends Schedule 1 to insert references to an additional twenty two sites to be
included for the operation of mobile speed cameras. These sites were
recommended by the Traffic Liaison Committee and assessed by the Traffic Camera
Office (TCO) and Roads ACT. The twenty two sites are located on arterial and
major collector roads across the ACT.
