EXPLANATORY
STATEMENT

This regulation is made under sections 24 and 33 of the Road Transport
(Safety and Traffic Management) Act 1999.
It provides for the
inclusion of two additional traffic offence detection devices, specifically a
laser speed measuring device and a radar speed measuring device, in section 102
of the Road Transport (Safety and Traffic Management) Regulation 2000.
The Australian Federal Police, which is responsible for enforcing traffic laws
in the ACT, has indicated that it is purchasing these devices to replace and
complement the existing range of devices used to detect speeding offences in the
ACT. These amendments will authorise their use in the ACT.

Clause 1 Name of Regulation
This
clause is a formal provision to set out the name of the
regulation.
Clause 2 Commencement
This clause is a formal
provision that sets the commencement of the regulation, which will be the day
after notification on the Legislation Register.
Clause 3 Legislation
amendment
This clause explains that the amendments in the regulation
apply to the Road Transport (Safety and Traffic Management) Regulation
2000.
Clause 4 Section 102, definition of laser speed measuring
device, new paragraph (e)
This clause has the effect of including the
laser speed measuring device known as the Laser Technology Inc. LTI 20-20
TruSpeed in the list of these types of devices. The effect of the inclusion is
to allow the police to use this make and model of laser speed measuring device
to detect traffic offences in the ACT.
Clause 5 Section 102,
definition of radar speed measuring device, new paragraph (e)
This clause
has the effect of including the radar speed measuring device known as the Kustom
Signal, Inc. Raptor RP-1 in the list of these types of devices. The effect of
the inclusion is to allow the police to use this make and model of radar speed
measuring device to detect traffic offences in the ACT.
