1)
EXPLANATORY STATEMENT
The Road Transport (Public Passenger Services) Amendment Regulations 2003
(No 1) is made under the Road Transport (Public Passenger Services) Act
2001.
New regulation 20A provides an exemption from the application of sub- section
20(2) of the Road Transport (Public Passenger Services) Act 2001
requiring operators of tour and charter bus services to be accredited in the
ACT.
The exemption is only applicable for interstate tour and charter
operators whose tour commences and ends outside the ACT and where all passengers
join and leave from the tour outside the ACT.
The exemption is also
limited to those bus operators who are authorised for tour or charter services
under the law of another jurisdiction.
The exemption is consistent with
the principles of mutual recognition of bus service operators.
The
regulation is made under section 65(1)(a) of the Road Transport (Public
Passenger Services) Act 2001.
