EXPLANATORY STATEMENT

SUPREME COURT AMENDMENT RULES 2003 (No 2)

The resident Judges of the Court (of whom there are currently four, including the Chief Justice) or any two of the resident Judges, may make Rules of Court regulating the practice and procedure of the Court pursuant to section 36 of the Supreme Court Act 1933.

These rules amend the Supreme Court Rules:

1. Order 20 has been amended to provide for service of a third or subsequent party claim outside Australia.

2. Order 34B has been amended to provide for service of a Notice for non-party production on all parties to the proceedings.

3. A new form of Notice for non-party production has been substituted. The new form sets out clearly all party’s obligations in complying with a Notice, in particular the ability to provide copies of documents and to whom the documents should be produced to.
