This Regulation is authorised by section 51 of the Transplantation and
Anatomy Act 1978.
The amendment to section 3 of the Transplantation and Anatomy
Regulation 2001 is to allow for all intensivists to be able to certify brain
death for the purposes of organ transplantation.
The list of
qualifications in section 3 has been amended to include the qualification of a
Fellow of the Joint Faculty of Intensive Care Medicine (FJFICM).
There is no additional cost involved in this Regulation.
Clause 1 – Name of Regulation – states the title of
the Regulation, which is the Transplantation and Anatomy Amendment Regulation
2009 (No 1).
Clause 2 – Commencement – states when
the Regulation commences. The provisions commence on the day after
notification.
Clause 3 – Legislation amended –
provides that this Regulation amends the Transplantation and Anatomy
Regulation 2001.
Clause 4 – New section 3(c) –
inserts a new subsection for the qualifications of medical practitioners who
can certify brain death as a Fellow of the Joint Faculty of Intensive Care
Medicine (FJFICM).
