TAXI AND PRIVATE HIRE CAR REGULATIONS (AMENDMENT) REGULATIONS 1987

EXPLANATORY MEMORANDUM

No. 17 of 1987

Paragraph 218(n) of the Motor Traffic Ordinance 1936 provides that the Minister may make regulations prescribing the payment of fares for the hire of taxis.

The Taxi and Private Hire Car Regulations (Amendment) 1987 (“the Regulations”) amend the Taxi and Private Hire Car Regulations (the “Principal Regulations”) to provide for the uniform application of two rates of flagfall to both single and multiple taxi hiring and for a revised radio fee. The details of the Regulations are as follows:

Regulation 1 deals with interpretation.

Regulation 2 inserts a definition of “public holiday” into the Principal Regulations.

Regulation 3 amends regulation 24 of the Principal Regulations by:

a) specifying two rates of flagfall or hiring charge which apply to both single and multiple taxi hiring, removing the distinction between flagfall rates for single and multiple hiring;

b) revising the flagfall charges and the times at which the charges apply:

- where the journey commenced between 6.00am and 9.00pm on any day other than a public holiday – a flagfall of $1.50 applies,

- where the journey commenced between 9.00pm and 6.00am on any day other than a public holiday – a flagfall of $2.40 applies,

- at any time on a public holiday – a flagfall of $2.40 applies;
c) including the first kilometre of travel in the hiring rate of both single and multiple hiring;

d) increasing the radio booking fee from 50 cents to 60 cents.

Regulation 4 repeals and substitutes Schedule 2 to the Principal Regulations which specifies the flagfall rate, radio booking fees and the kilometre rates. The Schedule is a notice of fares which is required to be displayed inside a taxi.
