Outline


The Trade Measurement (Miscellaneous) Amendment Regulations 2002 (No 1) (the regulations) amend regulation 4(2) of the Trade Measurement (Miscellaneous) Regulations 1991 by changing the maximum penalty from $2,000 to 20 penalty units. The monetary value of the penalty has not changed, but the wording is now in line with current drafting style and the penalty can be increased if the value of the penalty unit in the Legislation Act 2001 is increased.

Clause Notes


Regulation 1 – Name of regulations – provides that the regulations are the Trade Measurement (Miscellaneous) Amendment Regulations 2002 No 1).

Regulation 2 – Commencement – provides that the regulations commence on the day the Magistrates Court (Trade Measurement Infringement Notices) Regulations 2002 commence.

Regulation 3 – Regulations amended – provides that the regulations amend the Trade Measurement (Miscellaneous) Regulations 1991.

Regulation 4 – Regulation 4(2) – provides that regulation 4(2) of the Trade Measurement (Miscellaneous) Regulations 1991 is amended by changing the maximum penalty from $2,000 to 20 penalty units.
