UTILITIES (TECHNICAL REGULATION) (LIGHT RAIL––REGULATED UTILITY SERVICE) REGULATION 2016

Overview

The Utilities (Technical Regulation) Act 2014 (the Act) provides comprehensive technical regulation of regulated utility services such as the provision of electricity, gas and other forms of energy as well as water and sewerage services.

The Utilities (Technical Regulation) (Light Rail––Regulated Utility Service) Regulation 2016 (the Regulation) is made under section 10 of the Act. Section 10 (1) of the Act states a regulation may prescribe a regulated utility service for this Act if the Minister is satisfied on reasonable grounds that the service includes infrastructure for the provision of electricity, gas, another form of energy, water and sewerage. Section 10 (2) of the Act states a regulation may prescribe the regulated utility network and the infrastructure it consists of for a regulated utility service prescribed under section 10 (1).

A light rail regulated utility service includes infrastructure for the provision of electricity. This Regulation prescribes the supply of electricity from a light rail network under the Act. This provides an important regulatory framework for technical elements of the light rail system and the associated light rail electrical network.

Regulatory Impact Statement

A regulatory impact statement is not required for this Regulation as it does not impose any appreciable costs on the community.

Human Rights Implications

The Regulation will not have any impacts on individual rights. The Regulation only applies to a light rail regulated utility service. According to section 6 of the Human Rights Act 2004, only individuals have human rights.

Regulating a light rail regulated utility service will promote the provision of a safe and reliable service to the community. It will also ensure the safe and reliable operation and maintenance of regulated utility networks and services to protect the public, people working on the networks and services, properties and the environment.

Clause Notes

Clause 1 Name of regulation

This clause names the Regulation as the Utilities (Technical Regulation) (Light Rail––Regulated Utility Service) Regulation 2016.

Clause 2 Commencement

This clause provides the commencement day of the Regulation.

Clause 3 Dictionary

This clause notes that the dictionary provided at the end of the Regulation is part of the Regulation.

Clause 4 Notes

This clause clarifies that a note included in the Regulation is explanatory and is not part of the Regulation in accordance with the Legislation Act 2001.
Clause 5 Regulated utility service––Act, s 10 (1)
This clause prescribes the supply of electricity from a light rail network as a regulated utility service.

Clause 6 Regulated utility network and infrastructure––Act, s 10 (2)
This clause prescribes the regulated utility network and the infrastructure it consists of for a light rail regulated utility service. The components of the infrastructure are specified in subclauses 6 (2) and (3).
