EXPLANATORY
STATEMENT
Section 3A of the Victims of Crime (Financial
Assistance) Regulation 1998 made under the Victims of Crime (Financial
Assistance) Act 1983 provides that the maximum legal fee that a lawyer may
charge or recover in relation to a proceeding under the Act is currently
$650.
The cap on legal fees has not been increased since it was first set
in 1998.
This regulation adjusts the cap, in line with the Wage Price
Index, to keep pace with inflation.
As a result, the fee set under section
3A of the Victims of Crime (Financial Assistance) Regulation 1998 has
been increased to $1123.
