(1) The following provisions apply in relation to the holder of an office who is, by a provision of this Act, entitled to remuneration and allowances in accordance with this section:
(a) the holder of the office shall be paid such remuneration as is determined by the Remuneration Tribunal;
(b) if no determination of that remuneration by the Remuneration Tribunal is in operation, the holder of the office shall be paid such remuneration as is determined under subsection ( 2) by the Minister;
(c) the holder of the office shall be paid such allowances as are determined under subsection ( 2) by the Minister.
(2) For the purposes of paragraph ( 1)(b) or (c), the Minister may, by notifiable instrument, determine remuneration or allowances to be paid to the holder of an office.
Note: Notifiable instruments must be registered under the Legislation Act 2003 , but they are not subject to parliamentary scrutiny or sunsetting under that Act.
(3) This section has effect subject to the Remuneration Tribunal Act 1973 .
