Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) The Minister may, either generally or as otherwise provided in the instrument of delegation, by writing signed by him or her, delegate to a person any of his or her powers under this Act, other than his or her powers under subsection 9(5) (except where a power referred to in that subsection is exercised in pursuance of an application under subsection 9(6) by the holder of a permit), sections 11 and 12 and this power of delegation.
(2) A power so delegated, when exercised by the delegate, shall, for the purposes of this Act, be deemed to have been exercised by the Minister.
(3) A delegation under this section does not prevent the exercise of a power by the Minister.
