Commonwealth Consolidated Acts Commonwealth Consolidated ActsThe question whether an offence against the laws applied under subsection 4(1) is to be, or may be, prosecuted or dealt with on indictment or summarily shall be determined in accordance with the law that would be applicable in relation to a prosecution under the laws in force in the Jervis Bay Territory if the act alleged to constitute the offence had occurred in the Jervis Bay Territory.
