EXPORT CONTROL ACT 2020 - SECT 293

Third party authorised officers must not contravene conditions of authorisation

Fault - based offence

  (1)   A person commits an offence if:

  (a)   the person is a third party authorised officer; and

  (b)   the person engages in conduct; and

  (c)   the conduct contravenes a condition of the person's authorisation as a third party authorised officer.

Penalty:   Imprisonment for 2 years or 120 penalty units, or both.

Civil penalty provision

  (2)   A person is liable to a civil penalty if:

  (a)   the person is a third party authorised officer; and

  (b)   the person contravenes a condition of the person's authorisation as a third party authorised officer.

Civil penalty:   240 penalty units.
