Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) If a person applies under section 38 for review of a decision, the Secretary must review the decision and:
(a) affirm the decision; or
(b) vary the decision; or
(c) set the decision aside and substitute a new decision.
(2) The Secretary must give the person written notice of the decision made as a result of the review.
(3) The notice must set out:
(a) the terms of the decision made as a result of the review; and
(b) written reasons for that decision; and
(c) the person's rights to have that decision reviewed.
