Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) Subject to subsection 90YS(7), a superannuation agreement is in force at any time when the relevant Western Australian financial agreement is binding on the parties to the Western Australian financial agreement in accordance with the Family Court Act 1997 (WA).
(2) A flag lifting agreement is in force if, and only if:
(a) it meets the requirements set out in subsection 90YS(3); and
(b) it has not been set aside by a court and has not been terminated.
