FOREIGN STATES IMMUNITIES ACT 1985 - SECT 7

Application

  (1)   Part   I I (other than section   10) does not apply in relation to a proceeding concerning:

  (a)   a contract or other agreement or a bill of exchange that was made or given;

  (b)   a transaction or event that occurred;

  (c)   an act done or omitted to have been done; or

  (d)   a right, liability or obligation that came into existence;

before the commencement of this Act.

  (2)   Section   10 does not apply in relation to a submission mentioned in that section that was made before the commencement of this Act.

  (3)   Part   I II and section   36 do not apply in relation to a proceeding instituted before the commencement of this Act.

  (4)   Part   I V only applies where, by virtue of a provision of Part   I I, the foreign State is not immune from the jurisdiction of the courts of Australia in the proceeding concerned.
