MEDICAL INDEMNITY ACT 2002 - SECT 34O

Treatment of a claim that relates to a series of incidents some of which occurred after the exceptional claims termination date

    If:

  (a)   a claim against a person relates to a series of incidents; and

  (b)   some, but not all, of the incidents occurred after the exceptional claims termination date;

then, for the purposes of applying paragraph   34L(1)(e) and subparagraphs   34L(1)(f)(i) and (ii) in relation to the claim, an amount that an insurer has paid or is liable to pay, or would have been liable to pay, in relation to the claim, is to be reduced by the extent (if any) to which the amount relates or would relate to, or is or would be reasonably attributable to, the incident or incidents that occurred after the exceptional claims termination date.
