MARITIME TRANSPORT AND OFFSHORE FACILITIES SECURITY ACT 2003 - SECT 33

Secretary may give security directions

  (1)   The Secretary may direct that additional security measures be implemented or complied with.

  (2)   A direction under subsection   (1) is a security direction .

  (3)   The Secretary must not give a security direction unless:

  (a)   it is appropriate to do so because an unlawful interference with maritime transport or offshore facilities is probable or imminent; or

  (b)   if a national emergency declaration (within the meaning of the National Emergency Declaration Act 2020 ) is in force--the Secretary is satisfied that the security direction is appropriate to support the national emergency declaration.

  (4)   A security direction has no effect until the Secretary commits the direction to writing.

Note:   This requires the Secretary to have a written record of a direction that is given orally.

  (5)   The regulations may prescribe requirements for, or in relation to, the giving of security directions.
