NATIONAL CONSUMER CREDIT PROTECTION ACT 2009 - SECT 69

Obligation not to give authorisation that has no effect

Requirement not to give authorisation

  (1)   A person must not purport to authorise a credit representative under subsection   64(1) or 65(1) if, at the time the person first purports to give the authorisation, it is of no effect, to any extent, under this Division.

Civil penalty:   5,000 penalty units.

Offence

  (2)   A person commits an offence if:

  (a)   the person is subject to a requirement under subsection   (1); and

  (b)   the person engages in conduct; and

  (c)   the conduct contravenes the requirement.

Criminal penalty:   2 years imprisonment.
