Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) The rules may make provision for and in relation to empowering the Regulator to cancel the registration of a registered biodiversity project.

(2) Rules made for the purposes of subsection (1) must not empower the Regulator to cancel a registration unless:
(a) a certificate has not yet been issued in respect of the registered biodiversity project; and
(b) any of the following subparagraphs applies:
(i) 5 years have passed since the project was first registered, and the Regulator is not satisfied that the project has begun to be carried out;
(ii) the Regulator is satisfied that the project is not being carried out;
(iii) the Regulator is satisfied that the project is unlikely to be carried out in a way that would result in a biodiversity certificate being issued in respect of the project.
(3) Rules made for the purposes of subsection (1) must require the Regulator to consult the project proponent for the project before deciding to cancel the registration.
